How can I make a privacy complaint?
I want to make a complaint about a business misusing my personal information. The business gave my personal email and contact number to another business that has been constantly contacting me to purchase their services. How can I make a privacy complaint?
Lawyer Answers (1): Answers from lawyers are general preliminary responses. They are not formal legal advice and cannot taken account of all your circumstances. They do not create a lawyer–client relationship.
- To make a privacy complaint you must complain directly to the business, agency or organisation that you consider has breached your privacy and wait 30 days for a response.
- If they ignore you or you are unhappy with the response then you can lodge a complaint with the Information Commissioner.
- The Information Commissioner then investigates on your behalf.
- There are a range of orders that the Commissioner can make if it believes a breach of privacy law has occurred. This can include ordering the business to cease any actions that are in breach of the law.
