What searches are needed for trade mark registration?

I have completed a trade mark search. Is this enough?

  • It depends what the search comprises. At the very least you should include searches of:
  • the Trade Marks Office database for substantially identical and deceptively similar marks;
  • the Australian Securities and Investments Commission (ASIC) database for company and business names;
  • relevant directory searches;
  • corresponding domain name searches;
  • corresponding social media names; and
  • general internet searches.
