Can I re-marry before divorce is finalised?

We have filed a joint application for divorce. We have been separated for 3 years already. We both agree and want it over with. I want to re-marry. Can I just go ahead and do this?

  • No. You cannot remarry until your divorce has been finalised. You need to apply to the court. The court needs to make the Divorce Order. Then you still need to wait the one month and one day for it to take effect.
  • After this time has passed you will be free to remarry.
  • You will need to provide a court with a sealed Divorce Order as part of your application to remarry.
