What can I do if no party to the accident has insurance cover?

Last week I was involved in an accident in which my car was damaged through no fault of mine. The other driver and I exchanged details. The other driver has ignored my calls and has not paid the money they owe for damage to my car. Neither of us is insured. What should I do?

  • You should send a letter of demand to the driver.
  • The letter of demand should state the amount payable and a due date for payment.
  • The letter should state that if payment is not received by the specified date you may take legal action.
  • If money is not received by the due date you may wish to commence legal proceedings. This can be time consuming and costly and you should obtain further legal advice specific to your situation.
