Does the manufacturer's liability extend to other people even if they didn't pay for the goods themselves?

I recently bought a kitchen appliance that has overheated and my daughter has burned herself while baking muffins. Can I seek compensation on her behalf? Does the manufacturers’ liability extend to her injuries?

  • Yes. The protection provided by the Australian Consumer Law also extends to your daughter.
  • A   manufacturer is liable to compensate all persons injured through use of the defective product provided that the product was being used for personal or domestic use at the time of the incident.
