Is there any legal aid for people who can't afford a lawyer?

I have been out of work for years and I can't afford legal representation. I'm not even sure whether I have a successful claim. What should I do?

  • Although workers do not require legal representation for their application to be processed by the Dust Diseases Board it is always a good idea to seek legal advice before initiating any claim action.
  • It is very important to seek legal advice and obtain legal representation if you are making a common law claim in the Dust Diseases Tribunal.
  • Most law firms work on ‘no win no fee’ basis for dust diseases claims. This means that unless you recover compensation you will not be required to pay legal fees to your lawyers. However if you do not win you will still be liable to pay for the other party’s legal costs.
  • Most law firms also offer free initial consultation where you can discuss your matter and be advised on its prospects of success.
